🥃 Age statement (age on the label)

Concept ✔ Checked: 10.2026 · sources: 6 Updated:

Age mark on the label of whisky or brandy: under EU, Scottish and US law it is the age of the youngest spirit in the bottle; for Scotch, it is given in years only.

An age statement is the number of years on a bottle of whisky or brandy, for example “12 Years Old”. Under both EU law and the Scotch Whisky Regulations 2009, it means the age of the youngest spirit in the bottle, not the average or the oldest. Older spirits may be included in the blend, younger ones may not.

EU law. Regulation (EU) 2019/787 allows a maturation period or age to be stated only for the youngest alcoholic component, and only when maturation took place under official supervision or with equivalent guarantees. The colour of the drink does not prove age: caramel colouring is permitted.

Scotland. The Scotch Whisky Regulations 2009 (rule 12) repeat the youngest-component principle and add that the age of Scotch whisky may be stated only in years. The minimum for any Scotch is 3 years in oak casks in Scotland, so a whisky without an age statement is still at least 3 years old.

United States. Under TTB rules (27 CFR 5.74), age also means the youngest spirit. Whisky younger than 4 years must carry an age statement unless it is “bottled in bond”; brandy that spent less than 2 years in oak must also carry one. Understating the age is allowed, overstating it is prohibited.

Why it matters to you. “12 years” guarantees a minimum, not an average age. A bottle without a number (no age statement, NAS) meets the legal minimums, but the producer does not disclose the age. Age is not the same as quality: taste depends on both the cask and the distillery. The WHO reminds us that there is no safe dose of alcohol.

Frequently asked questions

Is it true that “12 years” on a label is the average age of the whisky in the bottle?

No. Under EU, Scottish and US law the age on the label is the age of the youngest spirit; older components may be included, younger ones may not.

What does NAS mean on whisky?

No age statement: a whisky without an age mark. It meets the legal minimums (for Scotch, 3 years), but its exact age is not stated.

Can the age of Scotch be stated in months?

No. The Scotch Whisky Regulations 2009 (rule 12) allow the age of Scotch whisky to be stated only in years.

When is an age statement mandatory?

In the US, for whisky younger than 4 years (except bottled in bond) and for brandy that spent less than 2 years in oak (27 CFR 5.74). In the EU an age statement is not mandatory.

Can the age on a label be understated?

In the US it is allowed to understate the age, but overstating it is prohibited; in the EU and Scotland the number must match the youngest component.
